When Should You Hire A Discrimination Attorney?

Posted on

As an adult, you go to work fully expecting that the people in your workplace and those who employ you will treat you fairly. However, it is an unfortunate fact that this is not always the case. Many people experience some level of discrimination in the workplace, whether it is because of their gender, sexual orientation, or race.

If you experience any level of discrimination, it is something you should never just shrug off, but how do you know when you should hire an attorney because of your experiences? Here is a look at a few situations when you should talk to a discrimination attorney for advice.

You were fired from your job because you are pregnant.

Even being pregnant can bring some levels of discrimination in the workplace, and you have a right to an attorney if you feel you have been discriminated against because of your condition. A good example of being discriminated against because you are pregnant would be if you are terminated from your job position because you are expecting a child. You may even be removed from your position when you have to take your maternity leave, which is also a form of discrimination if the proper rules are not followed. Your employer must legally hold your position for you for a certain length of time according to most state laws.

You were not hired for a job specifically because of your sexual orientation.

It is never asked on a job application and should not be asked in an interview. However, if your sexual orientation comes up during the pre-employment process and you believe you were not hired because of it, you should contact an attorney. Employers do not have the right to not hire you because of your sexual orientation. It can be hard to prove that this is why you were not hired, which can make these cases tricky.  So make sure you have some kind of concrete evidence that proves why you were not considered for the job position.

You have experienced racial discrimination in the workplace.

Racial discrimination is never okay, whether it comes from your supervisors or the people you work with. If you are being harassed or mistreated in the workplace by your fellow employees because of your race, your supervisors do have the responsibility to give you a safe workplace. If they do not, and the discrimination persists, you should reach out to an attorney for advice.
